The procurement regulation regulates the principles of procurement, their planning, establishes the methods, procedure and timing of procurement procedures, contains requirements for notification and tender documentation, determines the procedure for conducting closed procurement methods, and contains requirements for the procedure for concluding and executing contracts. The procurement regulation includes a complete list of methods for forming the initial (maximum) price, requirements for procurement participants and purchased goods (works, services). The criteria for evaluating the bids of participants, the specifics of procurement in electronic form and among small and medium-sized businesses, have been established. Antidumping measures, prequalification, rebidding and alternative proposals are auxiliary tools in the conduct of procurement procedures and are also determined by the Procurement Regulations. However, these requirements do not exclude the occurrence of delays in the delivery of products, refusal to fulfill or conclude a contract based on the results of the purchase. The article is devoted to considering the possibility of applying the Temporary Methodology for Determining the Amount of Damage (Loss) Caused by Violations of Business Contracts in the Application of Penalties under Product Supply Agreements concluded by Russian Railways under Federal Law No. 223-FZ dated July 18, 2011 «On the Procurement of Goods, Works, Services by certain types of legal entities».
